PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING AGREEMENT.

 

By submitting payment authorization, paying a deposit, signing a proposal, or otherwise engaging the services of Memories by Mangini Travel (“Agency”), Client acknowledges that they have read, understood, and agree to be bound by the following Terms and Conditions.

 

1. AGENCY STATUS

 

Agency acts solely as an independent contractor and intermediary for third-party suppliers providing travel services, including but not limited to airlines, cruise lines, hotels, tour operators, destination management companies, transportation providers, and insurance carriers (“Suppliers”).Agency does not own, operate, manage, supervise, or control any Supplier or any travel service provided. Agency is not a provider of travel services and assumes no responsibility for the acts or omissions of any Supplier.

 

2. ASSUMPTION OF RISK

 

Travel involves inherent risks, including but not limited to illness, injury, delays, cancellations, mechanical failures, weather events, political instability, civil unrest, crime, pandemics, quarantine restrictions, and force majeure events. Client voluntarily assumes all such risks and agrees that Agency shall not be liable for any injury, loss, damage, delay, inconvenience, or expense arising from travel.

 

3. LIMITATION OF LIABILITY

To the maximum extent permitted by law: Agency shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages .Agency’s total liability, if any, shall not exceed the amount actually paid to Agency for professional planning fees (excluding funds paid to Suppliers).Agency shall not be liable for loss of enjoyment, emotional distress, lost wages, missed connections, or additional travel expenses

 

.4. SUPPLIER RESPONSIBILITY

 

All reservations are subject to the terms and conditions of the applicable Supplier. Client agrees that: Agency is not responsible for Supplier defaults, bankruptcy, insolvency, strikes, schedule changes, overbooking, mechanical issues, or cancellations. Refunds are governed solely by Supplier policies. Agency does not guarantee refunds for any reason.

 

5. PRICING AND PAYMENT TERMS

 

All prices are subject to availability and change until confirmed with deposit.

Client acknowledges:

  • Promotional rates may expire without notice.

  • Currency fluctuations may impact pricing.

  • Fuel surcharges and government taxes may change.

  • Deposits are non-refundable unless otherwise stated in writing.

  • Failure to make timely payment constitutes cancellation by Client and may result in forfeiture of funds.

  • 6. CANCELLATION POLICY

Cancellation penalties are determined by the Supplier and may be up to 100% of the total trip cost. Agency is not responsible for refund timelines. No refunds will be issued by Agency for unused services, voluntary trip interruption, or “no-show” situations.

 

7. TRAVEL INSURANCE

 

Travel insurance is strongly recommended. If Client declines insurance, client acknowledges and agrees:

  • They assume all financial risk

  • .Agency is not responsible for any loss that could have been covered by insurance.

  • Agency has fulfilled its duty by offering insurance.

 

8. TRAVEL DOCUMENTATION

 

Client is solely responsible for:

  • Valid passports (minimum 6 months validity unless otherwise specified)

  • VisasREAL ID complianceHealth documentation

  • VaccinationsEntry and exit requirements

Agency is not liable for denied boarding, denied entry, missed flights, or penalties resulting from improper documentation.

 

9. MEDICAL FITNESS & SPECIAL NEEDS

 

Client warrants that they are medically and physically fit for travel. Client must disclose special needs at time of booking. Agency is not responsible for medical issues, accessibility limitations, or failure of Suppliers to accommodate special requests.

 

10. FORCE MAJEURE

 

Agency shall not be liable for failure or delay in performance due to causes beyond its reasonable control, including but not limited to:

  • Acts of God, natural disasters, weather events, pandemics, government restrictions, war, terrorism, labor disputes, civil unrest, mechanical failures, or transportation interruptions.

 

11. CHARGEBACKS & PAYMENT DISPUTES

 

Client agrees not to initiate credit card chargebacks without first providing written notice to Agency and allowing reasonable time for resolution. Improper chargebacks constitute breach of this Agreement. Client agrees to reimburse Agency for any fees, penalties, collection costs, and attorney’s fees incurred due to wrongful chargebacks.

 

12. INDEMNIFICATION

 

Client agrees to indemnify, defend, and hold harmless Agency, its owners, employees, contractors, and affiliates from any claims, damages, liabilities, losses, or expenses (including attorney’s fees) arising from:

  • Client’s acts or omissions

  • Client’s breach of this Agreement

  • Claims related to travel services provided by Suppliers

 

13. DISPUTE RESOLUTION

 

Any dispute arising from this Agreement shall be governed by the laws of the State of Connecticut. Venue shall be exclusively in the courts located in Litchfield County, Client waives the right to jury trial where permitted by law.

 

14. SEVERABILITY

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect.

 

15. ENTIRE AGREEMENT

 

These Terms constitute the entire agreement between Agency and Client and supersede all prior representations, whether written or oral.

 

16. ACCEPTANCE OF TERMS

 

Submission of payment constitutes electronic signature and acceptance of these Terms & Conditions.
